Chapter 13 Bankruptcy
A Chapter 13 bankruptcy is a plan in which you propose to pay some or all of your debts over a period of 3 to 5 years. The monthly plan payment is actually formulated by you and your bankruptcy attorney, and is based on your ability to pay. A Chapter 13 bankruptcy case gives you the opportunity to:
- catch up on mortgage payments, property taxes, and homeowners association dues
- catch up on car payments
- pay the IRS on favorable terms
- pay debts such as credit cards, loans, and medical bills to the extent your budget allows
- discharge debts that you cannot afford to pay
Chapter 13 allows you to consolidate your debts, without the uncertainty of having to negotiate with each individual creditor, and without the fear of being sued or harassed.
